If you're going to criticize me at least be educated. Read this. Nope, I don't feel bad at all about publishing these emails. I'm not the one who brought it to the boards, rather than deal with it professionally.

Hey man I wanted to email you and let you know I think its pretty uncool of you to use the banners i made for my alternate tour on your *new freesites*

Considering the deal we had for all that work, I think its shitty now to see these free sites covered with my banners that were to be used to send traffic to my tour now linking your blog. I designed those in good faith they would be used to promote my tour. I knew your affiliates would someday use them for your other tour, but to see you blatantly use them on hosted free sites and NOT LINKING my tour kind of sucks.

Im not gonna chase you down over this or make drama but this I have learned from this in dealing with people and design.

if you are going to use my banners will you at least send the traffic to my tour?

i was never paid for banner design, and now you link your blog with them?

I didnt design those banners so you could use them to push your blog.

I started replying to your email with the sentence "Did I not only pay regular price for that tour but also share the proceeds with you?" until I read the part where you get to the banners. You're right, you weren't paid specifically for the banners.

The story behind those free sites is this:

Boogie, from Boogie-Blog.com, created the blog: http://tour1.donnysgirls.com/ He has the same arrangement on that tour as you do on yours. He updates the blog every day and in return receives a percentage of all sales that result. He asked if he could use my promo materials to create free sites and I told him yes. I have a lot of promo materials to choose from. I had no idea what he'd choose. I gave him access to everything I had, including passwords to the members area. When he chose your banners I thought nothing of it, to be honest with you. It didn't even cross my mind that I only paid for the tour design. I just assumed the entire package was part of that. But I don't doubt you when you say those banners weren't part of it. He got those off this page:

http://www.donnysmoney.com/hostedgalleries.htm

I put them there and wouldn't have done so if I hadn't assumed I'd paid for them when I paid for the tour.

By the way, all of your hosted galleries are listed on Donny's Money for affiliates to use. I thought of asking you if you still wanted to add new ones from time to time and I'd send them out to affiliates. But I knew you are much busier now than ever before and sales weren't exactly kicking ass, so it was probably a waste of your time.

After all the work Boogie put into getting that blog done and making those free sites I will feel horrible asking him to change them. But I also don't like using something I haven't paid for.

Please tell me what you'd usually charge for the promo material on that page (http://www.donnysmoney.com/hostedgalleries.htm) and I'll pay you for it.

Thats fair and fine. My price has been the same for awhile. $15 a banner.

You can use it all as long as im paid and this is done.

15$ x 35 banners = $525 and thats for the banners listed here:

http://www.donnysmoney.com/hostedgalleries.htm

Let me know how you want to handle payment.. epass, check... etc...

and thanks for understanding. I put a lot of time into those banners and I
was prepared to look the other way if a few affiliates used them to link you
or something... but not for use in mass free site production. Thanks again
for being cool about it, they look great and i am sure they will help your
site make money.

Cheers DOnny

I told him I'd make it right. But considering that he'd been receiving 50% of the tour's profits without doing what he promised to do I thought the price he was asking was too high.

I didn't want to say that right away because the last time we had a problem Fletch went straight to the boards without even hearing from me. I mean, he didn't even confront me before to see what I had to say. He went to the boards and it turned out not being my fault at all.

So I decided to give it a few days to think about it and decide how I was going to handle this situation. How am I going to word things so Fletch doesn't blow up and get pushed out of shape?

So today, at 1:42pm PST

The reason I haven't responded yet is because I was thinking about this and there is indeed more to it than meets the eye. I'd imagine the points I'm about to make haven't even crossed your mind:

1. I paid you for the site design. The percentage of sales was for continuous new promo materials to keep giving to affiliates. This particular tour was therefore more of a "partnership". When sales didn't go as planned I didn't bother you to keep creating new affiliate promo tools.

2. If I pay you the regular price for these banners... that wouldn't be any different than doing so right up front and owning them all. It wouldn't make any sense to be into the site for regular price AND also sharing 50/50 sales revenue. The first check sent to you by CCBill was on 2/29/2004, so it's been on a revshare basis for a year and 6 months almost. I'd be in regular price plus whatever sales have resulted. I pulled the checks that were mailed to you. The cashable amount totals $582.36 not counting all future rebills.

Do you see my point here or am I on crack? I definitely want to be fair. But I want to be fair to ME too. Know what I mean?

Fletch flipped. At 2:51pm he went to the boards.

I was not trying to screw him. I just wanted to pay a fair price. I didn't think what he was asking was fair. He threw a fit like a little kid because he didn't think I was going to give him what he wanted.

I wanted a counter offer. I wanted him to see my side, too. He didn't. The rest is history.

I'm very PO'd right now. Why can't the guy handle things like a professional?

He thinks he's hurt my business and perhaps he has. But I've also received some ICQ comments that show his has been hurt by this too. Who wants to use a designer who will throw such a big fit and go public without giving an honest effort to work shit out?
