this post I made earlier. The main plaintiff, a photographer of images depicting sadomasochistic content, has said she will appeal the decision. The ruling of the three judge panel in this case is the opposite view of the judge in the Extreme Associates case, which held that the application of the "community standards" prong when judging obscenity made no sense in cases involving the Internet, since it is viewed in the privacy of ones own home. Of course, in Extreme Associates, the fact that the content was part of a members area and had to be accessed via a credit card made a big difference in the eyes of the Judge in that case. Other forms of payment, such as ACH and dialers, may not offer the same protection unless there is some sort of "adult verification" technique possible.
