Actually a republican - K Starr - tested this and won on two occasions back when he was after Clinton - Starr persuaded the U.S. Court of Appeals for the District of Columbia Circuit to follow the Eighth Circuit. The court ruled that exposure of wrongdoing by government lawyers fostered democracy, as "openness in government has always been thought crucial to ensuring that the people remain in control of their government." He had gone first to the Eighth Court to compell notes between Hillary and her counsel in the presence of White House counsel and won that one. He then proceeded to go for the Assistant counsels testimony which is how the US court of appeals got involved.
There is lots of precendence for this type of testimony and my guess is that the Democrats will play that to the tee.

I wont take sides as I dont have an affiliation with either group. I also have no delusions about the press being left or right wing - they are all led wherever their CEOs want them to go. I do know that there is not an un-biased news organization out there and its funny to watch their affiliations swing.
