Petition for what?
We have no idea who in the hell he will try to nominate anyways.
Not to mention presidents have been iratated before with a justice they nominated to the court. Up until they were sworn in that had the perfect little record that agreed with the presidents ideals, when they took the chair they were able to changed their mind and not worry about politics anymore.
