What he was charged with is in the story. What the story does do is prove that there are unresolved issues before the courts as usual and the decisions depend on how much muscle you have behind you.
Our court system is only as strong as the Judges who sit on the bench. If you have a good judge, one who is honorable and knows their stuff you can count on a brighter future. When you run into a judge ( believe you me I have more times than I can count ) who is on dope, alcohol, is a pervert, an asshole etc. sitting on the bench then you are one step away from a world of hurt.
In this case, Banister knew-his-shit and so did the Judge. It's going to escalate into more issues as this is something a long time coming.
