FLASHCA$H 2257 Statement

Even though FLASHCA$H is not US-based and has no offices in the USA, we take the new 2257 regulations seriously as they could affect our US-based affiliates.
After taking legal advice from several parties, we believe that the concept of 'secondary producer' will not stand up to a legal challenge as it exceeds the statutory authority of the Justice Department. The only truly relevant case so far is Sundance Assoc., Inc. v. Reno, 139 F.3d 804 (10th Cir. 1998), which held that the record keeping requirements could NOT be applied to secondary producers. Accordingly, we are joining the Free Speech Coalition to support them in their legal challenge against the new 2257 regulations.
While we only license content from suppliers who can supply proper 2257 documentation, we won't violate the privacy of our models by disclosing their identities to anyone other than law enforcement officials. We believe it to be a violation of the privacy of the models to do otherwise.
Accordingly, we will make softcore marketing materials available for those affiliates who want it. These marketing materials do not require 2257 information. Hardcore marketing materials will still be available as normal, and the FLASHCA$H sites are open for business and rocking!
