Admittedly...under the rules of the Geneva Convention...they are supposed to have a formal tribunal make this decision.
FYI...the reason there has not been a single military tribunal...to judge the status of and or sentence the detainees at Gitmo...is because the civilian courts have enjoined the military from holding military tribunals...so until the matter is settled with the civilian courts...the military cannot formally charge the detainees with anything.

This "deeming" tendency sounds bad. OK... So we now have "illegal enemy combatants"? Don't think that is any term under Internation law is it?? We just made it up to suit... Odd no other country has found their terrorists to have this wonderful status of being both "illegal" and "enemy combatants". But.. suppose it must be like "illegal aliens".
But then we throw in the Geneva convention and some concept that they are "supposed to have a formal tribunal make this decision." Yeah?? :-) Which is it, ya playing by the Geneva Convention or not?
Civilian courts? Ah.. you mean these places that normally decide on military justice in jurisdictions outside US terrirory and under the terms of the Geneva Convention?
Can't help but love the logic! Tho it's in keeping with everything else - it's always an "issue" and, as always, the US is 100% correct and faultless despite the foul reports from a number of international orgs re the concentration camp. Tho according to the Admin - they were all lying or biased. Yea.. dream on, - along with the WMD fantasy in Iraq.
I kinda "deem" there are a lot of idiots around.
