it is very conceivable that one of the rules to owning a ".xxx" TLD is that you must have your .com turned off, or try to convince them that there is a permanent redirect to .xxx

while this is no where written in the current charter, it is possible to have this part added.

this would plug the glaring hole that you are describing, that filters could be used to block the .xxx version of a site, but the .com version would still be there.
