Ahh...but they have been charged with a crime...and that crime is being being illegal enemy combatants. They are not soldiers and they do not represent any government. The sentence is to be detained until there are not anymore al Qaida members and Taliban fighters. The governments position is they do not have to try them and can hold them until they and or their orgs do not any longer represent a threat.
Personally I think they should be tried by Military Tribunal...and as I have stated those that are found to be members of al Qaida should be placed before a firing squad and those that are Taliban fighters should be detained until there are not anymore Tailban fighters in existence. The government has simply chosen to hold them...instead of executing them.
