LONDON, KY (AHN) - A Kentucky judge has come under fire for offering drug and alcohol offenders the option of attending church services instead of undergoing rehab or serving time.
Many say this violates the separation of church and state, but the judge defends his stance saying his goal is to help people and their families.
Alternative sentencing is nothing new, as judges occasionally order vandals to repaint graffitti-covered walls, but many legal experts say this is the first time a judge offers an offender the option to attend church.
According to the AP, District Judge Michael Caperton, has made the offer about 50 times to drug and alcohol offenders.
David Friedman, a lawyer with the ACLU of Kentucky says this raises a serious issue, as those willing to attend religious services can avoid jail time, while those who decline cannot. "That strays from government neutrality towards religion," Friedman added.
