I agree. Furthermore, what is to stop someone from claiming to be a person in a profile, and then asking that a picture be taken down (or profile deleted), when in fact it is not their picture/profile.
For example, you're pissed at someone, so you want to harass them by having their profile deleted or picture removed from their profile.
Back to the case at hand, the courts could easily compel the ex-boyfriend to delete the pictures, and impose a restraining order preventing him from engaging in the type of activity that he is engaging in.
To add one more wrinkle, if Yahoo is found liable, then people can conspire to set Yahoo up, by posting their own naked pictures, claiming it was done wrongfully, and then suing Yahoo for not removing the photos.
Yahoo will probably just pay the woman and her lawyer a few thousand to make the lawsuit go away, or if they fight it, they will probably prevail but could be out more money.
