All that says is that it is the affiliate's responsibility to ensure they are not violating any laws. Do you think any US affiliate program is going to take the time to check and see if a non-US affiliate is actually keeping the correct 2257 documents?
Non-US affiliates could just put up some bullshit 2257 notice on their sites because they know neither the US government or the people that run the affiliate programs are ever going to get on a plane and fly to their country to check and see if they are actually keeping any 2257 documents at all.
