The word before should indicate that the content was sent with the intent of him using it for site design BEFORE final payment was made and BEFORE any license was issued. Once the final payment was made, the license would have been issued and he would have turned the site on.

To this day he has not contacted me with an offer to make final payment. He's cried about everything else but never even mentioned the payment issue other than to say he would pay me once his solo girl site was up and running..Which, to my understanding, it has been up for a bit now.

IMO i think its better to refund asap instead of allowing it to drag on like this. You CANT say this debacle has helped your biz, though. I will admit the situation sounds sketchy, but if it was ME instead of SoS, especially with $ problems, there is NO FUCKING WAY i would let you 'keep' the money.
SoS, sorry man but if you exclaimed you had money problems yet you are ok with letting AaronM keep the downpayment, it just looks fishy.
