It's some old Capone shit and they know it. They have been trying to get obscenity cases for years - everyone from Lenny Bruce to Howard Stern and they can't do it.
Really, this is desparation on the part of the DOJ, they've tried to prosecute obscenity 9000 different ways and they can't do it, so they have to resort to some below the belt shit. It's sad really.
