Darth Vader, Darth Maul, Darth Sidious, and Lord Darth Vader are trademarked, but not "darth."
And although any of those could apply to a prosecution of that nature, they would have to prove that you were building on their use of the term. Of course, it doesn't have a corresponding meaning in the dictionary, so they would have a pretty good chance of doing that, but would they?
