-the teacher didn't know who the kid was talking to; the kid didn't tell the teacher who he was talking to
-phones aren't allowed on school grounds at that school (whether it should be or not is a different issue... it's not allowed apparently at this school and the kid knew it).
The teacher made the right decision based on what the teacher knew.
