Spam sucks. However, I'm pretty sure people aren't going to complain if you email them inquiring about buying a specific site or business that they own. I send out domain offers all the time - no one complains when you're offering them cash money. They may say NO, but that's about it.
If you're sending out bulk form letters then that's a different story.
