Legally, it's unclear how much of a case Milano has. Under First Amendment law, Americans don't have absolute control over their images. ''If we did, reporters would have to get permission every time they wanted to write about someone, and magazines would have to get permission every time they wanted to (run) a picture of someone,'' says Daniel Weitzner of the Center for Democracy and Technology.
