Rochard, go to court, and indicate that you were accellertating to attempt to pull away from a tailgater. You made the steps (flashing the taillights, etc) to attempt to get him to back off, and you had to take action to protect yourself. It wasn't clear to you that slowing down would have stopped the problem and considering the way things go on the roads these days, you feared that he might be armed (road rage).
The action of the police to tailgate you for any period of time without lights put more of the public at risk than any of your actions.
You might not win, but the judge will almost certainly give the cop a finger wagging.
