Let me clarify a few things:

AFF cannot enforce the exclusivity or ownership rights of promotional methods invented and used by our affiliates. We encourage our affiliates to be inventive and resourceful, but all good ideas get discovered by the masses and imitated -- sooner or later. Where we do have an opinion is in making sure that affiliates are in compliance with our T&C. There are a number of parties claiming to have been the originators of the banner format you can currently view on our Banner Farm. The gist is a combination of member images and a geo-sensitive element, based on IP detection and a 3rd party matching DB. I couldn't tell you who did it first, nor is that a piece of information there's very much I can do with.

Rather than individually police the numerous forms these ads began to appear in, and ensure they were all compliant, we decided to offer up an approved version ourselves.

At the moment, we are still transitioning a number of affiliates, who are using either ads they made themselves or ads made by others, over to OUR ads. The current ads of this type we are offering use images from a limited pool of images approved for marketing purposes outside our site. The next rev of ads will use an even larger pool of member images -- thus expanding their effectiveness (in places like Portugal, as requested by Tuga) even further.
