If its a dictionary word and not a brand name,then you have him over a barrel even if he has trademarked it.
A trademark will only prevent you from selling the same stuff he has a trademark for.Yoy can always make the site about somethhing different.Also unless its a real well known trademark he has got buckleys anyway.Hold out for thousands or carryon developing the site.
