Another thing to think about: It takes 60 Senators to override a filibuster, the Republicans (even counting moderates) only have 55.

While it's highly likely that there will be one or two or maybe more vacancies at the Supreme Court, the fact that the Judiciary Committee is chaired by a self-styled moderate Republican and the current Senate is not filibuster-proof, fears of a UBERCONSERVATIVE new Supreme Ct may be unfounded.

Personally, I'm betting on the Republicans picking a 'stealth' nominee with no paper trail like David Souter (initially conservative-leaning appointee by G Bush Senior who emerged as one of the more progressive voices on the Court) If you're into privacy rights and personal freedom, we can use more appointments like Justice Souter.
