We know that Bush plans on offering up very conservative candidates for not only the Supreme Court but also for Court of Appeals, Attorney General, FCC and any other positions that he can. We know this because he has done this without exception every time he was offered an opportunity. It is true that appointments require Senate approval, but lets look at the likely outcomes there:

a) The Senate stays Republican controlled (as it is widely anticipated it will). Bush's nominations go through.

b) The Senate becomes Democratic controlled. In this event if the Dems attempt to block confirmation, Bush has two tactics---he can start trading favors like has been a long time tradition in Washington or he can do a full court press with the media. A vacancy at the highest Court will get front page coverage as will the fact that confirmation is frozen due to Democrats. The heat on those democrats will be enormous and they could very well fold on that alone.

My real question to you is would you want to be in a position where you are relying on Democrats to block the confirmation of a Justice that will allow legislation that could dramatically affect your livelihood? Would it not be better at this point to seek to prevent the nomination from happening in the first place?
