If you weren't charged you can say no. If you were charged but found not guilty you can say no. Unless you are convicted they cannot make your arrest record public.
Unfortunately for me, I was convicted and now have to wait for a waiver to enter the US. The shit's costing me over $2000 to get processed. All for getting drunk and playing basketball at school after hours. (3 am)
