Yep, After reading over it a few times its clear that the site will be put in the index as the tour is not protected by an AVS and they will then send that second letter advising of this.
I dont think it can go further than that either but I'm sure the second letter will have more info and it does state that you can alter the website after recieving the 2nd letter to remove the "incriminating content" and then ask for the site to be removed from the index, so I dont see any trapdoors at this stage
