It's all about who has the money in this situation. Many large corporations do not own the urls for their trademarked names. Great example of how it works is
www.nissan.com Uzi Nissan is a pretty great guy, Nissan the car company got pissed off that he would not get off "their" name. He had this domain registered when Nissan heads in Japan outcasted their engineer here to America and told him he could only call his cars Daihatsu, Nissan did not even exist here yet by their choice! But what they did is file for "damages" about 2 years ago saying his url has done millions of dollars in damage and sued every business he owned as well as businesses he was a partner in even if Nissan did not appear anywhere in public documentation. It all started with a pretty rude letter. Likewise most car companies do not have their registered trademark names in direct urls. So it does not matter who had what first, it is who wants to pay for it. I would make him talk to me like an equal.
