Believe it or not we WERE compliant. These complaints are pre-CAN Spam, but non of them are unsolicited anyway so it does not matter. They all signed in 100% and we required not only that they click a link emailed to them but that they include (minimally) first,last,address, city,state,zip, date of birth (so we don't deal with child information privacy issues), and recorded IP and time of sign up in addition to page(url) and privacy policy link.

I still have about 60 Million of these, and the privacy policy we used clearly states that they will receive offers from third parties, and that they agree to have the info shared with partners/affiliates.

Furthermore the agreement to the privacy policy was pro-active , they had to check a currently unchecked box.

never "spammed" never will.
