I don't think it's legal even if people agreed to terms and conditions.
The thing is that visitors think that the shit comes from our sites. They load a dialer plugin for example or they are able to show a banner on your page (maybe illegal stuff). In my case they load a dialer plugin
and it looks like it comes from my site.
So thats the reason why we get the complains not they.

you'll see it is about Morpheus, an "Advertising Supported" free download. What all these free programs mean by "Advertising Supported" is additional, hidden, software programs that piggy back on the one the surfer wants. They cause pop ups, redirects, and all sorts of other "advertising opportunities" for the proprietors of the free software to sell.

The biggest company pulling this is Gator. Gator calls it "providing the surfer with linking alternatives". It's not against the law, but it does suck.
