I'm thinking that would be used as a precedent for this type of case if it were brought to court.

Just because Google does it doesn't mean it's not illegal. If they have an image of CP on THEIR server, they will be liable. Same as a TGP. The image resides on your server, therefore you'd be liable.

As for copyright, that has nothing to do with this discussion.
