The legalities of it are very much in question and a grey area like anything considered obscene.
Maplethorpe did have his gay anal fisting photo found not obscene in Ohio of all places. A couple of producers have also beat the obscenity laws on it.
Do keep in mind we are in California where the Miller test was born. Obviously this picture was taken not purely for sexual deviance or gratification but as a contest entry into a photography (art) contest.

I do think (far from being a lawyer) that since it was indeed shot for a photography exhibit that it would clearly fall into the realm of art and thus pass one of the Miller prongs.
