that girl is FUCKED.

if she was given a DUI on the case, you pretty much have an open and shut case (even though no cases are really open and shut) for the damages of the car.

If you do sue for pain and suffering, you are going to be going up against not her, but her insurance company, at least this is what I've seen from personal experience. You can claim all the pain and suffering you want, but if you don't have medical backup, then it most likely won't hold.. so unless you have any casts, serious medical issues resulting from the crash like severe migraines, andything like that which can be backed up with solid medical info that you didn't have it before the accident, but have it now, you may be able to get something.

but if you went to the hospital right after, and checked yourself out, with no problems - chances are you won't get anything for pain and suffering.
