Get advice from a lawyer. If you can afford it, get another place to stay with your child. Don't leave without your child but make sure you have what it takes to make it comfortable and have everything the child needs. If you can't get your own place, ask him nicely to leave, if he doesn't, call the police and make sure you have spoken with a lawyer to know your rights & have your parents or a sibling move in for a little while as a means of protection.
