In every state my son applied to colleges in, non-resident means anyone not a resident of THAT STATE, not just foreigners. And the schools have a set number of resident and a set number of non-resident openings. I'm sure a lot depends on the budget that particular year - don't forget those non-resident tuitions are what allows the resident tuitions to be lower.
