Okay, that brings the problem into more focus than before. In that regard yes, I agree.... the legitimate opt-in mailers do have a problem.... but I don't call those guys spammers in the first place. Opt-in and double opt-in, by definition is "wanted" so it falls outside the definition of spam, which by definition is "unsolicited" mail.... as in unwanted.
The legit mailing listers certainly do have a case.
