The problem comes when an ISP blocks all mail that looks like the newsletter, which is a formatted like a lot of spam, so the legitimate newsletter doesn't end up getting though to those that sign up.
That should be an easy to win legal case for someone.

a lot of legit mass emails are getting lost in spam filters.
imagine this.. US post office provides a service to filter your junk mail.. everyonce in a while they also take out the magazine you subscribed to, or a catalog you ordered, or a mail-in rebate you were expecting or even a letter from a friend!
i just ordered a harddisk online a few hours ago and the email containing my receipt ended up in my junk email folder.. i think they're crossing the line here.
