The can spam rules do apply to double opt-in e-mails.

They do not however apply to the changes that take effect on May 19th.

it is my understanding from reading the d.o.c.u.m.e.n.a.t.i.o.n.at the link below that " Prior Affirmative Consent" negates the need for a "Requirement to place warning labels on commercial electronic mail that contains sexually oriented material"
