Somebody someday is going to win a case just like this one on the grounds that the state cannot regulate the days of operation.
The argument was originally "we can't sell liquor on sundays because people are drinking instead of going to church."
Someone somewhere will eventually convince a judge that you can't tell someone they have to go to church and taking away all of their activities during that time.
Hopefully that will happen during the Kerry administration.
