Since Saddam will be facing a WAR CRIMES tribunal, I doubt he will be able to use the "official acts" defense doctrine. Usually, acts commited while pursuing state policy is a good defense against tort action (but this is weakened recently, depending on where you sue, you may not be able to use this). One of the key official acts cases date back to suits against the Nixon administration regarding its Vietnam policies.
