I think the fact that he's not costing you any money says a lot about how you should handle it. "What's the damage?" (in terms of $) is one of the things an attorney would want to know, the other one being are his pockets deep enough to make it worthwhile going after him? If he has to borrow someone's site design wholesale, I doubt if he's sharp enough to make it work for him anyway.
