It's seemingly more than just a coincidental resemblance. Enough to call it plagiarism (using someone else's ideas). However, can you do anything in html that's so fucking original that you can expect copyright protection? I'm not an attorney, but I doubt it.
He stole the "look and feel" of your site, no doubt about it. How do the courts react to "look and feel" arguments? The answer is to look at all the guitars that look almost exactly like Fender guitars. Fake Stratocasters, fake Telecasters.
Like I said, I'm not an attorney, but that's how I see it. If you want to be sure, ask an attorney.
