I disagree the representative told him what the only difference would be and it did not iclude 95th percentile. That rep is at fault if the excerpt of the conversation are accurate.

I sympathize with you and it would have been good public relations for them to point out to you significant differences between one plan and another. But the burden of checking TOS is ultimately on the buyer.
