That shouldnt be happening at all, DNS cache times out usually quite quickly, certainly after 3-4 weeks. The only possibility that I can think of off of the top of my head is that your old host had an extremely large TTL value in your dns records which some nameservers are still respecting. You need to contact your hold host and find out what TTL value they were using, if its small, then you need to verify your DNS setup and make sure that no one is missing something.
Also when you are 404'ing are you sure that people are being sent to your old site that doesnt exist anymore, or it could it just be some misconfiguration problems with your new host?

My Old host: I contacted them, they said they knew what the problem is and they would fix it, that was a week ago
My DNS set up has been checked over and over, I even called DirectNic
My New host: Disected the problem and server and assured me that the server is setup correctly, besides I have 10 other domains on that server, they are all fine.
404ing, yes they get an old 404 page I had on the old server. I removed the htaccess from the new server.
