He'll have to give it back in cash. Restitution is supposed to go to the party that was wronged but sometimes it doesn't make it there. He'll most likely get restitution whether he received a probation sentence or jail time. I don't know where you are from but stealing from a store here $200 or $20,000 first offender would be out on 2 years probation even with a public defendant. Research some local plea bargains and see what's up there.
