Yes, first time offenders usually get it easier, does depend on location though. But here's the deal, whether he was really guilty or not if he decided to fight it all the way and was found guilty AFTER a trial they will throw the book at him. Our court system likes sliding people in and out and taking their money. Waste their time they'll waste yours.
