Tell his lawyer. The guy will be out on probation in no time.
Edit: By the way, fighting to trial is not a good idea. If the company says they think he did it it's more like THEY KNOW HE DID IT. They're just saving the hardball for court if they must.
Plea bargain, lesser sentence, most likely probation. It's the American way.
