Strange things happen when domain owners put up no defence.
One of the worst cases was over Diablo.com -- in that case, there was the situation where NSI had changed the creation date of hundreds of thousands of domains in the WHOIS, and the complainant then argued that the domain was reg'd AFTER the TM. Ugh. (NSI later fixed all the creation dates, but since the domain owner didn't respond, the name was lost as the panel didn't know the truth)
