i don't see how this is any different than Mr. Skin, which supposedly gets by legally because the site is a news/review site and the celebrity nude clips come with some commentary.
Paris Hilton and this sex tape is definitely news. So if it's news and presented as news maybe it would be legal to show it. Of course no court would agree with you if you were charging access for it - but if u put it out there for free with some news commentary it might be legal.
