Can someone please help me to understand some things here? It's REALLY bugging me to no end here!!!

I have been in this business for 19 months or so now, and I am STILL trying to figure out a few things. I moderate for reportchildporn.com , ok....... I got handed a site yesterday that contains very young naked girls on it... site is hosted in the USA, said site has a webmaster program..... the whole bit. BUT whenever I report a site like this, I am told they cannot do anything about it because there is no actual PORN on it and they get by with it by saying that it's artistic....... MY ASS!!!! They set it up to sell off of porn sites, they show very young..... I am thinking this girl is about maybe 10 or so........ girls on it, and use other porn sites to sell these sites.

Now maybe I am a dumbass or something but I honestly in my heart of hearts do not see how this is even in the slightest bit tolerated, they are very young and what? Just because they show no penetration, they can actually get by with this? They can sell it as a porn site.... knowing damn well what perverts are going to do with it..... and this is ok?

Am I this much of a dumbass that I am not getting it? Someone please tell me how this is acceptable and yet if there is any actual sex going on, this is a no-no........

Don't get me wrong...... NONE of it should be tolerated and I think that any and all adults involved, even on an "artistic" level should be shot in the damn heads....... but if it's artistic, then what loophole allows them to sell it as a porn site and this is fine? It's really starting to piss me off.

I bring this here because there doesn't seem to be any assholes around that are going to just have a pissing match with me.... I truly want to understand so maybe it doesn't bug me as bad when I see this shit.. it tears my heart out, artistic or not, it just doesn't seem right to me.
