Mate it all depends on the circumstances and what the name is.Whether its a generic domain or such.There is no set rule and alot is decided in court if it ever gets that far.If you want to keep the domain then you may have a good chance.If you want to sell it to them ask for heaps as it will probably cost them a fortune in legal fees to try and get the name off you.
