Your point is COMPLETELY irrelevant.
The owner of the property gets to decide how, when, where, and why the content is distributed, not you. They don't want it distributed on p2p networks and the people distributing it know they are breaking the law.
They deserve to be sued and they deserve to pay.
And, IF what you claim is true, than record sales would not be down so dramatically, they would be up.
